Pre-Order Policy

What is a Pre-Order?

A Pre-Order is an opportunity to purchase an item that is currently out of stock but will be available at a future date. By placing a Pre-Order, you secure the item upon its release, ensuring you don’t miss out due to potential sellouts elsewhere. Estimated availability dates for Pre-Ordered items are provided in the product description but are subject to change based on the manufacturer’s schedule.

How long will it take for my Pre-Order to arrive?

Once we receive your Pre-Ordered item, we will contact you via phone and email within 1-3 business days. You will also receive an email confirmation when the item has arrived in our warehouse. If your order includes multiple Pre-Ordered items, we will ship each item as it becomes available. Please note that some items may arrive sooner than others.

When will I be charged for my Pre-Order?

To secure your Pre-Order, payment will be processed at the time of purchase.

Can I cancel my Pre-Order?

Yes, you can cancel your Pre-Order by contacting us at info@e-motousa.com within 24hours from the time of your order. Please note that cancellations are subject to a 10% cancellation fee. After 24 hours there is no cancellation available and you would be charge 100% for your order.

Why did another retailer receive the item before mine became available?

Manufacturers ship to retailers on different schedules. It is common for products to reach some retailers 4-6 weeks before others. Rest assured, your item will be released as soon as we receive it. We recommend subscribing to our email newsletter for the latest updates on shipping and availability.

What happens if the release date of my Pre-Order changes?

Pre-Order release dates are subject to change based on the manufacturer’s timeline. Factors such as production delays, shipping challenges, and supply chain disruptions may affect these dates, particularly in the wake of COVID-19. We will keep you informed by updating product descriptions, sending email notifications, and posting updates on our Pre-Order Update Page as soon as new information becomes available.

What Option should I choose during checkout?

  • Local Pickup With Assembly – We’ll unbox, assemble, set up, and charge the item. It will be ready for pickup at our Kahului store.
  • Free Local Pickup – You can pick up your order in its box directly from our Kahului warehouse. You will be responsible for proper assembly and setup, as well as any issues that arise during assembly, including missing or damaged parts.
  • Home Delivery – We will deliver your fully assembled and tested order, complete with all accessories, to your address within a 10-mile range of Kahului.

Warranty Coverage


E-Moto USA will provide warranty coverage to the Customers who have made a purchase directly through E-Moto USA Warranty coverage is not transferrable to second-hand purchasers of the products. The Customer is responsible for labor associated with effecting any repairs on their products. E-Moto USA will assist with repairs via telephone providing step by step instructions or detailed videos on how to properly repair your products. Labor is not included with your warranty.


Yadea Products Warranty

All Yadea ebikes (the “ebike”), and their individual Covered Components (as defined herein), are protected against all manufacturing defects in material or workmanship for one (1) year after receipt of the ebike by the customer (the “Warranty Period”). This Limited Warranty is only applicable to United States ebike purchases (purchases in Canada and the European Union shall be subject to their respective warranty terms) and in accordance with the following terms:

  • Only the original owner of an ebike purchased from Yadea’s online store is covered by this Limited Warranty. The Warranty Period begins upon your receipt of the ebike and shall end immediately upon the earlier of the end of the Warranty Period or any sale or transfer of the ebike to another person, and under no circumstances shall the Limited Warranty apply to any subsequent owner or other transferee of the ebike.
  • The Limited Warranty is expressly limited to the replacement of a defective lithium ion battery (the “Battery”), frame, forks, battery, motor, motor controller, LED display, throttle, brake, front light, rear light and charger (each a “Covered Component”).
  • The Covered Components are warranted to be free of defects in materials and/or workmanship during the Warranty Period.

60 Months Limited Warranty for Motor

  1. The warranty for motors shall be limited to repairing service only and no replacement shall be provided, as follows:
  • Customers who can not provide invoices, warranty cards, failure videos and motor numbers;
  • Exceeding 3 months from the date of customer purchase;
  • Sample motor, unlocking speed-limiting motor.
  1. The warranty for motors is 60 months. Some of the parts (e.g. motor wiring harness, Hall, nylon gear, stator, grease) can be maintained once every 2 years and three times in 5 years for free.
  2. Warranty coverage
  • Free service during the warranty period: quality problems such as performance failure and can not be repaired, phase absence, burn-out of line, demagnetization, shedding of magnetic steel, deformation of wheel shaft, fracture, gear damage, bearing damage, etc.
  • Disputed matters: Inlet water of motor needs to be determined by both parties. If it is confirmed that the quality problem caused water inflow on the technical standard of IPX5, we provide replacement free of charge.
  • Out-of-warranty and paid service : motor line cut-off, leakage, impact caused by external force, customer self-disassembly and modification, warranty card purchase invoice missing or altered , Non-YADEA spare parts assembly, problems caused by non-YADEA product quality, natural disasters . Costs incurred during the repair service shall be paid by the customer. Costs for spare parts are charged according to the spare parts price list. Labor fees are charged according to Americas Standards.

This Limited Warranty Does Not Cover

  • Normal wear and tear of any Covered Component (as mentioned above).
  • Consumables or normal wear and tear parts (including without limitation tires, tubes, brake pads, cables and housing, grips, chain and spokes).
  • Any damage or defects to Covered Components resulting from failure to follow instructions in the ebike owner’s manual, acts of God, accident, misuse, neglect, abuse, commercial use, alterations, modification, improper assembly, installation of parts or accessories not originally intended or compatible with the ebike as sold, operator error, water damage, extreme riding, stunt riding, or improper follow-up maintenance.
  • For the avoidance of doubt, Yadea will not be liable and/or responsible for any damage caused by use, speed unlock, hardware or software modifications, failure or loss caused by any unauthorized service or use of unauthorized parts.
  • The Battery is not warranted from damage resulting from power surges, use of an improper charger, improper maintenance or other such misuse, normal wear or water damage.
  • Any products sold by Yadea that is not an ebike.

DETERMINING WHETHER DAMAGE OR DEFECT TO AN EBIKE OR COVERED COMPONENT IS PROTECTED BY THIS LIMITED WARRANTY SHALL BE IN THE SOLE DISCRETION OF YADEA.

NOTES

  1. Buyer shall provide VIN & pictures of faulty parts for warranty claim.
  2. Warranty begins from the sales date of end customer/from the bill of lading date plus 3months if date of sales can not be offered/from bill of lading date plus 6months if unmarketable of buyer
  3. Warranty as the above list for family use ebikes, warranty period will be half for non-family use ebikes (sharing, lease, express delivery, take out delivery)
  4. Warranty does not start over for replaced parts. Warranty of replaced parts accords with the remaining warranty of the ebike. Warranty of new parts paid by customer will start over.

For Our E-Scooters

1) 12 Months Limited Warranty for Motor & Main Body of Scooters

The warranty includes: Frame assembly, hub motor, controller assembly, handlebar, front body, control panel & switch button, rear hub, disc brake disc, disc brake assembly, seat tube, front fork, front fork rotating parts, main line cables, brake lines

2) 6 Months Limited Warranty for Accessories

The warranty includes: Batteries, chargers, brake levers, throttle shifters, tires, inner tubes

2) 3 Months Limited Warranty for Appearance wearing parts

The warranty includes: Headlight assembly, instrument cover, grip cover, bell assembly, fender, brake, decorative cover, parking bracket assembly, pedal base plate, foot pad, charging port seat, rubber plug

This Limited Warranty Does Not Cover:

  1. Unauthorized maintenance, misuse, collision, negligence, abuse, liquid ingress, accident, modification, incorrect use of non-product accessories or tearing, altering labels, anti-counterfeiting marks;
  2. It has exceeded the validity period of the three guarantees;
  3. Damage caused by force majeure;
  4. Damage caused by man-made reasons (including but not limited to scooter ingress of fluid, tire puncture, impact, traces and damage caused by normal use of the appearance, etc.);
  5. If this product is used for commercial use, it will not be guaranteed.

TORP LIMITED PRODUCT WARRANTY

E-Moto warrants that all of its products are free from defects in workmanship and materials under normal use and conditions for a period of 2 years from the original invoice date.

The warranty does not cover the following:

  • Damage resulting from negligence, improper installation, or misuse.
  • Damage caused by using tools not included in the original product packaging.
  • Damage resulting from unauthorized modifications, miswiring, or testing of the product.
  • Damage caused by natural disasters.
  • Theft or loss of the product.
  • Any damage to the plastic shield.
  • Surface scratches that do not affect the functionality of the product.
  • Any legal issues related to the use of our product in your country.

In case of a warranty-related issue requiring product replacement, please follow this procedure:

  1. Provide proof of purchase showing that the product is still within the 2-year warranty period.
  2. Contact Torp’s technical support team  first at support@torp.hr with the product’s serial number and a detailed description of the problem.
  3. Torp team will assess whether the product requires further in-house inspection.
  4. If the product needs to be returned for inspection, the customer is responsible for covering shipping costs.
  5. The replacement product must be shipped to the customer free of charge, but the customer is responsible for covering shipping costs.

RIDING GEAR and APPAREL WARRANTY

All sales are final. Products purchased in wrong sizes may be exchanged for the same brand, model and the same price if available only if the wrong size product is in original, unused condition in the original packaging with original tags. In any case customers are responsible to cover a shipping cost. All products sold by E-Moto USA online or at the store are warranted to be free from defects in workmanship and materials for a period of one (1) year from the date of purchase unless stated otherwise. This warranty is extended to the original purchaser only and does not apply if damages are caused through abuse, negligence, improper repairs, inadequate fit, modifications and alterations or if used other than the manner intended. E-Moto USA makes no other express warranties or guarantees. Any warranties implied by law shall be limited to ninety (90) days in duration. E-Moto USA shall not be liable for any incidental or consequential damages. If you suspect that your product contains a defect, you may send the product to E-Moto USA for a warranty evaluation at any time within the first year of purchase. Damaged products covered by warranty will be repaired or replaced with an item of comparable size and style, at Fox’s sole discretion. Damaged products deemed not covered by E-Moto USA’s warranty policy will be shipped back to you. Goods intended for sale internationally are not intended for repurchase within the USA, and the warranty is void.

  1. The 50cc-250cc Motorcycles feature the following warranty coverage:
    1. 1-Year Standard Parts Warranty (unless stated otherwise on the product listing page): During the first month of ownership, E-Moto USA will cover both the parts and shipping costs associated with the replacement of any defective component on the product. Following the first month of ownership, but prior to the expiry of a period of 12 months from the date of ownership, E-Moto USA will continue to cover the costs associated with the replacement of any defective components on the Motorcycle (excluding labor, wear and tear items OR physically damaged or due to the customer negligence damaged items), subject to the customer only paying for shipping costs.
    2. Subject to any extended warranty purchased at the time of the order, the Warranty period will come to an end at the expiry of a period of 12 months from the date of ownership, and customers will be responsible to pay for both parts and shipping costs on all replacement parts requests.
    3. Extended [Inclusive] Parts + Shipping Warranty (1 Year, 2 Years or 3 Years): In the event that an extended warranty was purchased at the time of the order, E-Moto USA will cover both the parts and shipping costs associated with the replacement of any defective component on the product. During this extended warranty timeframe, E-Moto USA will cover the cost of any defective component related to the engine and transmission under normal use and care. The owner will remain liable for labor, wear and tear items OR physically damaged or due to the customer negligence damaged items.
    4. Due to the fragile nature of body fairings, they are not covered by any warranty other than shipping damages reported within 48 hours of receiving your vehicle.
  2. The 50cc – 250cc ATV’s, Dirt Bikes and Pocket Bikes/Mini Choppers feature the following warranty coverage:
    1. 1-Year Standard Parts Warranty (Included with ALL purchases): During the first month of ownership, E-Moto USA will cover both the parts and shipping costs associated with the replacement of any defective component on the product. Following the first month of ownership, but prior to the expiry of a period of 12 months from the date of ownership, E-Moto USA will continue to cover the costs associated with the replacement of any defective components on the Motorcycle (excluding labor, wear and tear items OR physically damaged or due to the customer negligence damaged items), subject to the customer only paying for shipping costs.
    2. Subject to any extended warranty purchased at the time of the order, the Warranty period will come to an end at the expiry of a period of 12 months from the date of ownership, and customers will be responsible to pay for both parts and shipping costs on all replacement parts requests.
    3. Extended [Inclusive] Parts + Shipping Warranty (1 Year, 2 Years or 3 Years): In the event that an extended warranty was purchased at the time of the order, E-Moto USA. will cover both the parts and shipping costs associated with the replacement of any defective component on the product. During this extended warranty timeframe, E-Moto USA will cover the cost of any defective component related to the engine and transmission under normal use and care. The owner will remain liable for labor, wear and tear items OR physical damages.
    4. E-Moto USA makes no express or implied representations and warranties that it will be able to replace body fairings in the original colors of the product purchased by the Customer. In the event that the Customer is not satisfied with the color of the replacement fairings, he will be responsible to arrange for painting of the replacement body fairing, at his own expense. Due to the fragile nature of body fairings, they are not covered by any warranty.
  3. Electric Bicycles, Motorcycles, Mopeds, scooters, ATV’s and Dirt Bikes feature the following warranty coverage:
    1. 1-Year Standard Parts Warranty (Included with ALL purchases) unless stated otherwise: During the first month of ownership, E-Moto USA will cover both the parts and shipping costs associated with the replacement of any defective component on the product. Following the first month of ownership, but prior to the expiry of a period of 12 months from the date of ownership, E-Moto USA will continue to cover the costs associated with the replacement of any defective components on the Motorcycle (excluding wear and tear items OR physical damages), subject to the customer only paying for shipping costs.
    2. Subject to any extended warranty purchased at the time of the order, the Warranty period will come to an end at the expiry of a period of 12 months from the date of ownership, and customers will be responsible to pay for both parts and shipping costs on all replacement parts requests.
    3. Extended [Inclusive] Parts + Shipping Warranty (1 Year, 2 Years or 3 Years): In the event that an extended warranty was purchased at the time of the order, E-Moto USA will cover both the parts and shipping costs associated with the replacement of any defective component on the product. During this extended warranty timeframe, E-Moto USA will cover the cost of any defective component related to the engine and transmission under normal use and care. The owner will remain liable for wear and tear items OR physical damages.
    4. E-Moto USA makes no express or implied representations and warranties that it will be able to replace body fairings in the original colors of the product purchased by the Customer. In the event that the Customer is not satisfied with the color of the replacement fairings, he will be responsible to arrange for painting of the replacement body fairing, at his own expense. Due to the fragile nature of body fairings, they are not covered by any warranty.

Exclusions

The following causes of damage are excluded from E-Moto USA Warranty programs:

  1. All damage caused by accidents, whether intentional or due to negligent or improper operation of the vehicle.
  2. All modifications or alterations to any standard specifications or equipment. All upgrades, modifications or installation of after-market parts must be done at the Customer’s own risk, and the Customer is liable for any damage caused due to such alterations.
  3. All damage was caused by negligent use of parts which were not provided or recommended by E-Moto USA for repairs or alterations to standard specifications.
  4. All damage was caused by failure to perform factory scheduled service maintenance. The buyer is entirely responsible for the maintenance of the purchased product.
  5. All damage occurred because of improper storage.
  6. All damages caused by the improper or negligent use of fuel or lubricants, and/or failure to use proper oil/gas mixture on 2-stroke models.

The following standard wear and tear parts are specifically excluded from warranty coverage:

  1. Rubber parts
  2. Tires
  3. Belts
  4. Brake linings
  5. Brake parts
  6. Cables
  7. Filters
  8. Spark plugs
  9. Bulbs
  10. Batteries
  11. Sprockets
  12. External springs
  13. Seat
  14. Hand grips.
  15. Physical Damage due to accidents and/or negligence
  16. Damage caused by water on electric components.

All servicing done to E-Moto USA products must be carried out by qualified professionals to maintain warranty coverage. Failure to utilize qualified personnel to effect repairs will result in the warranty coverage being cancelled.

Failure to inspect damages on delivery will prevent the Customer from filing a damage claim at the expiry of 48 hours from the time of delivery and Customer will be liable to pay for replacement parts.

Assembly


E-Moto USA requires all vehicles purchased to be Fully Assembled and Tested by a certified mechanic. This is a requirement for all Motorcycle, Scooter, ATV, Pocket Bike, Dirt Bike, Go-Kart, UTV, Mini Jeep, etc. Pre-Delivery Inspection requires a mechanic to check all features of the vehicle for functionality and make any adjustments as needed. Unless stated otherwise, E-Moto USA will ship most of their products 85%-95% assembled prior to shipping at no additional charge. If this option is selected at checkout, the customer will be required to take the vehicle to a certified mechanic to Fully Assemble + Test. It is the customer’s responsibility to maintain records of the assembly/testing performed at a mechanic shop. E-Moto USA will also provide the option to Fully Assemble + Test the vehicle before shipping to the customer if not shipped to the customer directly from a manufacturing warehouse. E-Moto USA will provide the customers with Technical Support and Instructional materials, upon request.

E-Moto USA will securely place its larger products in a protective crate. Certain parts and materials may be found inside the storage compartment underneath the seat of the vehicle.

The Customer will be responsible to carefully verify that all screws, nuts and bolts are well tightened prior to using the vehicle for the first time and will also take reasonable steps to periodically do safety inspections of the bike before driving.

The Customer will always ensure that all fluid levels are proper enough to safely operate the vehicle according to the manufacturer’s recommended specifications. E-Moto USA strongly recommends that the customer replace the existing motor/engine oil (i.e” packing oil”) already in the vehicle’s motor/engine, after 5 hours break-in period. For the vehicles’ first oil change, E-Moto USA recommends using 10W40 motor oil unless stated in the product manual.

Returns


ALL SALES ARE FINAL.

E-Moto USA does not offer Exchanges, Returns, or Refunds of any kind on any items offered for sale in our stores.

Inspect all details: Please inspect all items carefully before purchasing them. E-Moto USA offers a wide selection of photos and/or videos of the products that we sell to help with the sizing and performance of the vehicle.

If the buyer is dissatisfied with the product or has any issues with the performance of the vehicle, we urge them to work with our Technical Support team for assistance in getting started again.

MSO / MCO / Registration


E-Moto USA warrants that some of its listed items are DOT approved, and, unless stated otherwise, are sold as authorized off-road vehicles.

E-Moto USA will provide the Buyer with a standard Manufacturer Certificate of Origin (MCO) and Bill of Sale which can be used for registration. All documents are filled out per state regulations and notarized.

The Customer will be responsible for taking all reasonable steps to ensure that the purchased vehicle meets the local State requirements for registration. E-Moto USA encourages all customers to inquire with their local DMV or State authority, prior to purchasing an item intended for Road use.

E-Moto USA will not issue any refunds on the basis that the Customer was unable to register a vehicle.

Legal Disclaimer


The purchaser acknowledges the nature of motor vehicle use and motorcycle-related activities and will ensure that the user is qualified to operate said motor vehicle and is in proper physical condition to participate in such activity.

The purchaser agrees to assume all inherent risks when allowing others to operate the purchased item. Adult supervision is required for children under the age of 16.

Purchaser assumes all risks and dangers related to the use of the purchased motor vehicle, including but not limited to disability, paralysis, dismemberment, and death. These inherent risks and dangers may be caused by Purchasers own actions or inactions, the actions, or inactions of others. There may be additional risks, including social and economic loss, either known or unknown to Purchaser, not readily foreseeable, and Purchaser fully accepts and assumes responsibility for all such risks, losses, costs, and damages incurred because of participation in the before mentioned activities.

Purchaser expressly releases E-Moto USA and all its affiliates of any liability for damages arising from the use or misuse of the purchased vehicle, including but not limited to, loss of revenue and for any monetary damages suffered due to manufacturer defects.

The purchaser is responsible for registering and operating the purchased motor vehicle in accordance with local and state laws and ordinances. The seller makes no representations that its bikes are legal for operation in specific City, State or Province.

American LIFAN warranty


AMERICAN LIFAN 2 YEARS LIMITED WARRANTY FOR ONLINE PURCHASE

Coverage

The warranty covers the first owner from the date of purchase for 24 months or 12,000 miles, whichever comes first. American LIFAN warranty all parts of the vehicle except those listed under the caption “What is not covered”. This warranty covers the parts needed to correct defects in material. This warranty does not cover labor cost and is not transferable.

What must you do?

  1. After purchase, you must submit warranty registration card back to American Lifan either by mail or email. You must maintain a record of the vehicles required periodic service and inspection. Periodic service and inspection are considered regular Maintenance and are not reimbursable.
  2. You are required to maintain a record of the initial inspection which will be required upon application for any benefits covered by the LIFAN limited warranty.
  3. You must properly use, maintain, and care for the vehicle as outlined in the American LIFAN Owner’s manual.

What is not covered? (Warranty exclusions)

  1. Any damage resulting from negligence of the periodic maintenance.
  2. Any damage with results from repairs, adjustments, or maintenance operation by any methods other than those specified by American LIFAN.
  3. Any damage which results from hard driving due to race, rally or operation in a location not generally used for driving.
  4. Any damage which results from use beyond the limitations specified in the American LIFAN Operations Manuals such as overloading the vehicle, or any damage from the use under normal conditions.
  5. Any damage caused when the product is used as a rental/commercial use vehicle.
  6. Any damage which results from use of non-genuine parts of accessories or fuel, lubricant or fluid not specified by American LIFAN.
  7. Any damage which results from modifications of the product.
  8. Any damage that results from the passage of time (natural fading of painted surface, shell peeling and other deterioration); Consumable replacement parts due to natural wears and tears such as spark plugs, drive chains, drive belts, air cleaner’s elements, brake shoes, clutch disks, light bulbs, batteries, rubber parts, tube & tires, oils and cables.
  9. Any damage due to improper storage or transport.
  10. Any damage which results from repairs adjustment or maintenance operations performed by any person other than American LIFAN distributors or the dealers.
  11. Any damage which results from unavoidable natural disasters, fire, collision, theft, and second damages base in any other these occurrences.
  12. Incidental of additional expenses insured for making any claims such as those for towing, communications, hotel and meals as well as any losses during maintenance period, such as lose of time loss of business and rental car expenses.
  13. Schedule maintenance and inspections fees.
  14. Any aftermarket parts including Electrical, or engine replacements installed on the motorcycle or scooter.
  15. Any Routine Maintenance.

SMS Mobile Message Marketing Program Terms and Conditions


E-Moto USA (hereinafter, “We,” “Us,” “Our”) is offering a mobile messaging program (the “Program”), which you agree to use and participate in, subject to these Mobile Messaging Terms and Conditions, and Privacy Policy (the “Agreement”). By opt-in to any of the Programs, you agree to be legally bound by these Terms and Conditions as updated from time to time and agree to have read our Privacy Policy.

This Agreement is limited to the Program and is not intended to modify other Terms and Conditions or Privacy Policy that may govern the relationship between you and Us in other contexts. We may also modify or update this Agreement at any time and your continued use of the Program following the effective date of any such changes shall constitute your acceptance of such changes.

The Program allows Users to receive SMS mobile messages by opt-in to the Program, such as through online or application-based subscription forms. Your consent to receive automated marketing text messages is not required as a condition of purchasing any goods or services. Regardless of the opt-in method you used to join the Program, you agree that this Agreement applies to your participation in the Program. If you have opted in, the Program provides updates, alerts, information, promotions, specials, and other marketing offers (e.g., product discounts) from E-Moto USA via text messages through your wireless provider to the mobile number you provided. SMS mobile messages may be sent using an automated telephone dialing system or other technology. Message frequency varies. You are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message and data rates may apply.

If you do not wish to continue participating in the Program or no longer agree to this Agreement, you agree to reply STOP to any mobile message from Us in order to opt-out of the Program. You may receive an additional mobile message confirming your decision to opt out. You understand and agree that the preceding options are the only reasonable methods of opting out. You also understand and agree that any other method of opting out, including, but not limited to, texting words other than those set forth above or verbally requesting one of our employees to remove you from our list, is not a reasonable means of opting out.

You acknowledge that any messages, including any STOP requests, you send to a telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.

The wireless carriers supported by the Program are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. You agree to maintain accurate, complete, and up-to-date information with us related to your receipt of messages, including, without limitation, notifying us immediately if you change your mobile number.

You agree to indemnify, defend, and hold us harmless from any third-party claims, liability, damages, or costs arising from your use of the Program or from you providing us with a phone number that is not your own. If at any time you intend to stop using the mobile telephone number that has been used to subscribe to the Program, including canceling your service plan or selling or transferring the phone number to another party, you agree that you will complete the Opt-Out process set forth above prior to ending your use of the mobile telephone number. You understand and agree that your agreement to do so is a required part of these terms and conditions. You further agree that, if you change your telephone number without notifying Us of such change, you agree that you will be responsible for all costs (including attorneys’ fees) and liabilities incurred by Us, or any party that assists in the delivery of the SMS mobile messages, as a result of claims brought by the individual(s) who are later assigned that mobile telephone number. This duty and agreement shall survive any cancellation or termination of your agreement to participate in any of our Programs.

You agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Program, any errors in such information, and/or any action you may or may not take in reliance on the information or Service. You may not use or engage with the Platform if you are under eighteen (18) years of age. By using or engaging with the Platform, you acknowledge and agree that you are not under the age of eighteen (18) years. By using or engaging with the Platform, you also acknowledge and agree that you are permitted by your jurisdiction’s Applicable Law to use and/or engage with the Platform.
